Data protection concerns: Court order for OpenAI
Following a court order dated 13 May 2025, OpenAI is now required to retain all log files and separate them from files that contain user data or have been flagged for deletion by users.
A log file is a record generated by software during operation. The record may contain error messages, as well as information on usage and operation. In the case of ChatGPT, this could include, for example, information about users, their prompts and responses.
Various publishers and authors, including the New York Times, have been taking legal action against OpenAI and Microsoft since 2024. The publishers allege that the large language models (LLMs) were trained using their intellectual property, causing them to lose revenue in various ways.
This order is now raising concerns regarding data protection. It remains to be seen whether, and to what extent, personal data will be found in the log files.
Users of ChatGPT and ChatGPT integrations, such as those provided by Microsoft, should bear in mind in future that any interaction with ChatGPT may, until further notice, be logged and used in the aforementioned legal proceedings.
The Chat AI platform, which is used at the UDE, also features OpenAI models. Here too, the log files are stored by Microsoft for 30 days.
